1. Acceptance of Terms

By accessing and using ResortHub's platform, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to these Terms of Service, please do not use our services.

2. Description of Service

ResortHub provides a marketplace platform that connects timeshare owners with travelers seeking vacation accommodations. Our services include:

  • Listing timeshare properties for rent
  • Booking vacation accommodations at listed properties
  • Facilitating communication between owners and guests
  • Processing payments and managing reservations

3. User Accounts

To access certain features of our platform, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Maintain the security of your password and account
  • Accept responsibility for all activities that occur under your account
  • Notify us immediately of any unauthorized use of your account

4. For Timeshare Owners

4.1 Listing Requirements

Owners who list their timeshare properties on ResortHub agree to:

  • Provide accurate and complete information about their property
  • Ensure they have the legal right to rent their timeshare
  • Comply with their timeshare developer's rental policies
  • Respond to booking requests within the specified timeframe
  • Honor confirmed reservations

4.2 Commission and Fees

ResortHub charges a 10% commission on successful rentals. There are no upfront listing fees. Payment is processed at guest checkout, and owner payouts are issued according to our payment schedule.

4.3 Bid Queue System

Booking requests enter a live queue accessible to all eligible owners. The first owner to accept a request secures the reservation. Owners must respond within the specified timeframe or the request will be offered to other owners.

5. For Guests

5.1 Booking and Payment

Guests agree to:

  • Provide accurate booking information
  • Pay all fees associated with their reservation
  • Comply with property rules and resort policies
  • Treat the property with respect and care

5.2 Cancellations and Refunds

Cancellation policies vary by property and are clearly stated at the time of booking. Refunds are subject to the specific cancellation policy agreed upon during reservation.

6. Prohibited Activities

Users may not:

  • Violate any laws or regulations
  • Infringe on intellectual property rights
  • Post false, misleading, or fraudulent content
  • Harass, abuse, or harm other users
  • Attempt to circumvent our platform to avoid fees
  • Use automated systems to access the platform without permission
  • Interfere with or disrupt the platform's operation

7. Liability and Disclaimers

ResortHub acts as a marketplace platform connecting owners and guests. We are not responsible for:

  • The condition, safety, or legality of properties listed
  • The accuracy of listings or user-provided information
  • The performance or conduct of users
  • Disputes between owners and guests
  • Property damage or personal injury

Our platform is provided "as is" without warranties of any kind, either express or implied.

8. Indemnification

You agree to indemnify and hold ResortHub harmless from any claims, damages, losses, liabilities, and expenses arising from your use of the platform, your violation of these terms, or your violation of any rights of another party.

9. Dispute Resolution

Any disputes arising from these terms or your use of ResortHub will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You waive your right to participate in class action lawsuits.

10. Modifications to Terms

ResortHub reserves the right to modify these Terms of Service at any time. We will notify users of significant changes via email or platform notification. Continued use of the platform after changes constitutes acceptance of the modified terms.

11. Termination

We reserve the right to suspend or terminate your account at any time for violation of these terms or for any other reason at our discretion. You may terminate your account at any time by contacting our support team.
